ACKNOLEDGMENT OF RISKS
Participation in any water sport exposes the participant to certain risks and dangers. Accidents and injuries (superficial to fatal) resulting from the forces of Mother Nature, other boaters (both power and sail), malfunctioning equipment, unseen obstacles, fatigue, and your own misjudgement are a very real possibility. Ultimate Wake Yacht & Boat Rental LLC considers safety to be its utmost concern and as such, its staff includes individuals trained in lifesaving, water safety instruction, C.P.R. and First Aid. The nature of these sports, however, makes it impossible to foresee and protect the participant from all conceivable dangers associated with water and water sports. Once the participant leaves the safety of the shore, he/she must be prepared to assume all risks associated therewith.
RELEASE OF INDEMNITY AND LIABILITY AGREEMENT
- I hereby affirm that I understand the dangers to me or my dependents by my participation in any boat tour activity and/or water sports activity with ‘Ultimate Wake Yacht & Boat Rental LLC’ or otherwise known as ‘Ultimate Wake Dubai’.
- I hereby agree to indemnify and hold harmless in any way the company ‘Ultimate Wake Yacht & Boat Rental LLC’ otherwise known as ‘Ultimate Wake Dubai’ or any of its staff, owners or shareholders from any and all liability for any harm, injury, death, or damages (physical, mental, or monetary), regardless of fault or negligence, which may occur by participation in this program/tour/activity or while using ‘Ultimate Wake Yacht & Boat Rental LLC’ facilities, services and equipment. This release shall be binding upon my family, heirs, and administrators.
- The undersigned hereby certifies that they are a proficient swimmer and agree to wear a life vest.
- I hereby agree to adheer at all times to the advice and instructions of Ultimate Wake Yacht & Boat Rental LLC staff and to practice common sense water safety procedures.
- I also freely and voluntarily waive all claims for damages or loss to me personally or my property, or the person or property of third parties and release Ultimate Wake Yacht & Boat Rental from any and all claims.
- I am competent to make this statement and above is true to the best of my knowledge, information and belief. I am not under the influence of any drugs or alcohol at the time making this statement.

I UNDERSTAND THAT BY BOOKING ANY SERVICE/PROGRAM/TOUR/ACTIVITY ON THIS WEBSITE, I AM WAIVING VALUABLE LEGAL RIGHTS, INCLUDING ANY AND ALL RIGHTS I MAY HAVE AGAINST THE OWNER, THE OPERATOR NAMED ABOVE, OR THEIR EMPLOYEES, AGENTS, SERVANTS
